Subject to the following encumbrances: As shown on current title
(Mortgage #011 058 165 to be discharged).
Includes: fridge, stove, microwave, dishwasher, and all window coverings
located in the house, all “as is”.
Conditions of Tender:
1. Bids to be in writing and in a sealed envelope which must be submitted
on or before 12:00 noon, Tuesday, April 22, 2025 to: MHR Law
LLP Attn: Raylene M. Kloihofer #1-5401-49th Avenue, Olds Alberta
T4H 1G3. All parties will be notified of the status of their bid by
4:30pm, Tuesday, April 29, 2025.
2. All bids must be unconditional.
3. All bids must include a telephone number for the bidder. If multiple
bidders submit an equal highest bid, such bidders will be given
twenty-four (24) hours notice to either increase their bid or maintain
their existing bid. If such bidders do not respond in writing within the
twenty-four (24) hour period, they will be deemed to maintain their
existing bid.
4. A Deposit of 5% of the tendered amount by way of Bank Draft
or Money Order must be included with all bids. Deposits shall be
payable to MHR Law LLP “in trust”. Deposits will be returned to
unsuccessful bidders. If a bid is accepted and the successful bidder
does not complete the purchase, the deposit shall be forfeited in
full as damages.
5. The successful bidder shall have access to the farmland portion as of
Thursday, May 1, 2025 in order to perform fieldwork and shall have
general liability insurance in place during the early possession period.
6. The closing date shall be at 12:00 noon, Thursday, May 15, 2025.
7. The owners shall retain possession of the house, shop, barn, and yard
until Sunday, June 1, 2025. No rent will be payable but the owners will
be responsible for all utilities and their own contents insurance.
8. Bidders are responsible for their own due diligence as the lands will be
sold “as is” without any warranties or representations by the Owners.
9. All usual adjustments, including property taxes, shall be made as of
the closing date. Each party will be responsible for their own legal fees.
10. GST shall be applicable in this transaction and will be in addition to the
tendered price unless the successful tenderer is a GST registrant.
11. The successful bidder will be required to obtain title insurance to
facilitate closing due to land titles delays.
12. The highest bid or any bid will not necessarily be accepted and
acceptance shall be at the sole discretion of the Owners.
